AFFIDAVIT OF PROBABLE CAUSE FOR ISSUANCE OF ARREST WARRANT

Your Affiant, Lieutenant Herek Hees is now, and at all times herein mentioned was, a law enforcement officer employed by the Beautiful View Police Department.

Affiant is informed and believes, and on such information and belief, and in good faith, states that probable cause exists for the issuance of an arrest warrant for:

Name: Victor H Peoples

DOB: 03-03-1968

OLN State & #: Flat Water, #XXXXXXXXX

Physical Description: Black, Male, 6’5”, 220 lbs. Blk hair, Bro Eyes

Current Address: 345 Cave Stone Road, Plain-29 of Flat Water

For the following Criminal Offenses: Terroristic Threats (28-311.01), based upon the following events which occurred 12/31/2021, Beautiful View of Flat Water:

On Friday, 12/31/2021 at approx. 1139 hours, victim, Salem Great Hill received a phone call at her residence at 11222 Dilling Street, Beautiful View of Flat Water, from her estranged husband, Victor Peoples. During the phone call, Victor told Salem that either she, Salem (DOB 8-22-1972), their son, Flowers Peoples (DOB 8-14-1996), Flowers’ girlfriend, Whoisit Waitress (DOB 3-8-2003), or he, himself, were going to be sacrificed that day (12-31-2021). Victor Peoples further explained that someone was going to die.

Salem stated that Victor was not making sense, and she was in fear for her life. Salem had knowledge that Victor had access to firearms. Salem said that her and Victor were married for 27 ½ years and had been separated for 2 ½ years. Victor lives in Plain-29 of Flat Water and works at STALAG Plain-29 Site. Salem did not know Victor’s address as she stated he was too paranoid to tell her. Salem called 911 at 1145 hours making officers aware of the threats before leaving the home with Flowers, Whoisit and the family dog. Salem believed that Victor was capable of harming himself or all of them. She spoke about Victor’s military service and believed he suffered from undiagnosed mental issues that he, in the past, had refused to address. The Hunter County Sherriff’s Office was called to check the well-being of Victor at 345 Cave Stone Road, Plain-29 of Flat Water where his phone was pinged to.

Officer K. Nanning spoke with a Hunter County Sherriff’s Office Sergeant. The Sergeant stated to her they made contact with Victor around 0900 hours that morning for a check well-being. The reporting party for that call was Victor’s boss. According to the Hunter County Sergeant, Victor’s boss was concerned about his state of mind. His boss was aware that Victor thought he wanted to kill him. The Hunter County Sergeant stated they did not find any probable cause to place Victor in Emergency Protective Custody at that time, so they left Victor’s residence. Another check well-being was requested by Beautiful View Police and Hunter County S.O. was provided with our most recent info of threats of self-harm and homicidal statements.

At approximately 1420 hours, Beautiful View Officers received information from Sickle County Dispatchers who stated Salem called in stating that she was advised by Hunter County that they attempted to make contact with Victor in his vehicle but he fled from them and they were unable to pursue due to icy conditions, and that they believed he was headed for her house as he was last seen southbound into Black River County.

At approx. 1435 hours, Officers of the Beautiful View Police Department responded back to 11222 Dilling Street address. Sergeant Black and Ofc. Benny was first on scene at the Dilling Street address. When they arrived, Victor was exiting the residence with a small white laundry basket in his hands. He proceeded down the driveway and dumped out the laundry basket that contained bottles of liquor. The bottles of liquor shattered all over the driveway. Also in his right hand was a silver firearm. Sergeant Black started giving him loud verbal commands to drop the weapon. Victor began shouting back at them various expletives and that he was at his home and had the right to have a firearm. He continued refusing to put the gun down. At one point he was yelling at them to just shoot him. He was not being compliant at all.

After nearly an hour, Victor finally set the gun down. He began taking his boots off as well as his socks. He then began shouting out military physical training drills and doing them in his front lawn. He would roll over and kick his legs up. He eventually grabbed the firearm again and put it in a small firearm bag and put it in a black backpack he had nearby. He then grabbed a black bible out of his backpack and began praying. He eventually sat back down on the lawn and scooted away from the backpack containing the firearm.

With enough space between him and the firearm, Victor received pepper balls to the back and was taken into custody by officers. He was eventually taken to Flat Water Medicine Beautiful View, where he was placed in Emergency Protective Custody and remains there at this time.

With the above information received from numerous officer’s reports, I am requesting a warrant for Mr. Victor Peoples on the charge of Terroristic Threats.
