I have credible information, from multiple sources including Local Law Enforcement, Mental Health Officials, Corporate Security Firms, Cargill, Family Members and Former Colleagues on the Deceitful, Dastardly and Diabolical Smear Campaign done against Your Servant from a few of the Officers of the Blair COVID-19 Steering Committee along with several members of the Blair Site “Leadership” Team and a Certain Tech located at the Evonik Blair Site in the Cargill Campus in Blair, NE.
The Site Director and Probable Blair COVID-19 Steering Committee Chairman’s multiple 911 calls and False Reports to Washington County Sheriff’s Department Sergeant Cody Anderson was the beginning of a series of events that directly led to Your Servant being placed in Emergency Protective Custody for 10 Days at the Mental Health Ward in the Bellevue Medical Center and ultimately being ALLEGED TO BE A MENTALLY ILL AND DANGEROUS PERSON by the Washington County Attorney’s office. The lack of a formal or systematic examination by Evonik Corporation and Local Law Enforcement of the Site Director’s False Reports was the beginning of a series of events that directly led to my transfer (by Bellevue Police Department) from the Bellevue Medical Center to Sarpy County Jail and ultimately being charged with: COUNT 1: TERRORISTIC THREATS and COUNT 2: OBSTRUCTING A PEACE OFFICER by the Sarpy County Attorney’s Office.
To exacerbate Your Servant’s situation, the Certain Tech, I believe at the behest of the Evonik Blair COVID-19 Steering Committee, spewed a Public Disinformation Campaign on my Former Colleagues to stifle discourse, deflect his role in the Rudimentary Air Quality Test in the DSP Building and distract from the Norbert Email–the Certain Tech helped write–while he was on the clock. Furthermore, the Certain Tech, I believe at the behest of the Evonik Blair Site “Leadership” Team, continued his treachery with a private Misinformation Campaign on my Beloved Former Wife, Beloved Lil Sis and eventually Your Servant–during his two separate visits at Sarpy County Jail–to demoralize my Family and to discourage me while he was off the clock.
In addition, the Certain Tech refused to speak the Complete Truth with my Former Colleagues, Local Management, OSHA, my Washington County District Court Case No. 294 Attorney Linsey Moran Bryant of Sidner Law in Fremont, NE and neither of my Sarpy County District Court Case No. CR22-85 Attorneys James Owen of Owen Law in Plattsmouth, NE or Don Schense of Schense Law in Bellevue, NE.
Within 40 Days of receipt of this letter, I STRONGLY RECOMMEND that Evonik Corporation does the following:
- Per the Site Announcement Email sent From J.E. (on the behalf of the Blair Site “Leadership” Team) on or about Tuesday, January 4, 2022, at approximately 4:33 PM. Hire an Attorney–I Gently Suggest Kutak Law Firm in Omaha, NE–to complete the investigation on my alleged “…insubordination and violation of company policy and the Evonik Code of Conduct.” I Am willing to fill out Interrogatories and partake in Depositions provided I Am allowed to review the Purported Evidence Evonik Blair Site “Leadership” Team has against me.
- Per the RE: Smell in DSP Email sent From K.L. on or about Sunday, September 6, 2020, at approximately 1:22 PM. Hire an Attorney–I Gently Suggest Linsey Moran Bryant of Sinder Law in Fremont, NE–to investigate the lack of follow up by the Evonik Blair Site “Leadership” Team of the Air Quality Concerns of the DSP Building after the Rudimentary Air Quality Test Conducted by the Certain Tech and Concerned Chemist on or about Saturday, September 5, 2020.
- Both the Evonik Blair COVID-19 Steering Committee and the Evonik Blair Site “Leadership” Team need Instruction in Conflict Resolution. Hire a Conflict Resolution Firm—I Gently Suggest Pollack Peacebuilding—to provide Training in Conflict Resolution, De-Escalation and Workplace Culture Optimization. Cautionary Observation: I SRONGLY RECEMOND NOT hiring Empan Consulting Firm of Strasbourg, France nor its Business Partners Mark Miller Consulting, INC; Total Talent Management; Herrmann International Europe; GSI Group; or VCL Solutions as it could be a Conflict of Interest because of Todd Gray of Empan is a probable material witness if this matter regrettably escalates to Litigation.
- Both the Evonik Blair COVID-19 Steering Committee and the Evonik Blair Site “Leadership” Team need Direction in Ethics and Morality. I Insist the Peter Hayes book “From Cooperation to Complicity: Degussa in the Third Reich” become Required Reading at least annually for any Evonik Blair members of Management or Evonik Blair Employees in Leadership Positions.
- Per the Announcement Email sent by P.C. on or about Friday, December 31, 2021, at approximately 9:08 AM. Hire an Attorney—I Gently Suggest David V. Drew of Drew Law Firm P.C., LLO in Blair, NE—to investigate the conversation I had with the Certain Tech when he visited me twice at Sarpy County Jail. Both times the Certain Tech discussed company business with me even though I was suspended and/or terminated. Our talks about the supposed OHSA Investigation of the DSP Building, his Phase II Assignment and his Fictitious Tasks were of particular interest. Presumably, the Certain Tech was aware our conversations–in Sarpy County Jail On-site Visitation Area–were subject to monitoring and recording.
- The Site Wide Do Not Employ email From Unknown sent on or about Tuesday, January 31, 2023, at Time Unknown with my picture must be retracted. My picture and vehicle description must be removed from any guard shacks on the Cargill Campus located in Blair, NE.
- The Certain Tech pays me 30 Troy Ounces of .999 Physical Silver–I Insist– purchased from Joe Pflug of A Coin Shop in Ashland, NE.
So to Recap, Evonik Corporation will hire Law Firms to investigate me, the Certain Tech, the Site Director’s False Reports to Local Law Enforcement and the lack of follow up on my Air Quality Concerns in the DSP Building. Evonik Corporation will also hire a Third-Party Consultation Firm and purchase adequate copies of the Peter Hayes book “From Cooperation to Complicity: Degussa in the Third Reich” to provide needed Moral Compass Training for the Evonik Blair COVID-19 Steering Committee, the Evonik Blair Site “Leadership” Team and any Evonik Blair Employees in Leadership Positions. Evonik Corporation will Inform Cargill and Site Security that the Bar of Entry Notice—I believe Issued by the Evonik Blair COVID-19 Steering Committee–for Robert Nicholas on Site has been lifted. Evonik Corporation will Inform Cargill, the other Tenant Corporations and Joint Ventures located at Cargill Campus in Blair, NE, that the Do Not Employ Directive—I believe Issued by the Evonik Blair Site “Leadership” Team–has been Rescinded for Robert Nicholas. The Certain Tech will pay Robert Nicholas 30 Troy Ounces of .999 Physical Silver. Evonik Corporation will not have to apologize, will not have acknowledge any wrong doing and will not have to take any other action and I will consider my Pending Personal Injury from Defamation of Character Claim as settled favorably.
As Almighty Allows, I would like to resolve this matter within 40 Days of Evonik Corporation’s receipt of this Letter. Please consider my Peace Offering. It is not my desire to involve attorneys–in regard to my Personal Injury from Defamation of Character Claim–which would increase stress, time, and costs for both parties. On or about 12/27/2021, in order to Annoy the Non-essentials, Anger the Blair Site “Leadership” Team and Amuse the Essential Workers, Your Servant Robert Arthur Nicholas of Sarpy County and [Redacted] wrote up an Allegorical Fundraiser Invite which Simultaneously and Symbolically Pointed my Forefinger into the Chest of the Blair COVID-19 Steering Committee and my Middle Finger to Face of Evonik AKA Degussa’s Fascist COVID-19 Countermeasures and Out of Order Code of Conduct. [Redacted] sent a sitewide Email of our Allegorical Fundraiser Invite and posted copies throughout the Admin Building. Meanwhile Your Servant personally Hand Delivered our Allegorical Fundraiser Invite to whom I thought (as I never did receive an accurate roster) was on the Blair COVID-19 Steering Committee. In a hilarious turn of events, I Hand Delivered our Allegorical Fundraiser Invite to the Site Director as he was Reading the Signed Special Petition to the Blair COVID-19 Steering Committee that was Hand Delivered earlier by my Fellow Servant Andrew James Wacker of Washington County. Your Servant incorrectly thought a Suspension would come by Close of Business.
On or about 12/28/2021, to Your Servant’s surprise, no Suspension via text, phone call or email. Shockingly, my Scan Card worked at the Gate and the Door. I still was prepared to be escorted Off Site at any time. Finally, at approximately 09:15 AM after sample rounds, the Downstream Plant Manager “Invited” [Redacted] and me to a Disciplinary Meeting with the Site Director at approximately 11:00 AM in the Executive Conference Room. I excitedly predicted a Write Up for [Redacted] and a Suspension for me. I had visions of extending my probable Two Week Suspension to a One Year Unpaid Sabbatical. Once again, to my Surprise, no Suspension. To my Disgust, no Write Up for [Redacted]. To my Shock and Disappointment, the Allegorical Fundraiser was Authorized to happen. I was Authorized to address some of the “members” of the COVID-19 Steering Committee and [Redacted] sent out a Sanctioned Fundraiser Invite via Email. I replaced the Allegorical Fundraiser Invites with the Sanctioned Fundraiser Invites that were posted in the Admin Building. I also Hand Delivered Sanctioned Fundraiser Invites to those whom the Site Director stated was on the Blair COVID-19 Steering Committee.
What the Site Director did not Comprehend, but I Discerned, and I believe the Downstream Plant Manager Detected, is the entire Dynamics of the Disciplinary Meeting Changed the Moment the Site Director Filed his False Report regarding my Air Quality Concerns of the DSP Building during my Verbal Warnings. I made no further attempt to Train the Site Director in Leadership, Communication and Compassion. Any semblance of Credibility, Dependability and Integrity the Site Director had, Evaporated! So, I Immediately Transitioned into Collectively Bargaining on the Behalf of the Special Petition, which in my view, was the Written Warning of the Essential Worker’s Displeasure of the Performance of the Blair COVID-19 Steering Committee.
On or about 12/29/2021, Your Servant Covered on C Crew to raise awareness of the Blair COVID-19 Steering Committee and to answer questions on WHY and HOW the Disciplinary Meeting Transitioned to a Collective Bargaining Meeting with the Site Director and Downstream Plant Manager. I left early to purchase food for the Fundraiser. Interestingly, a Prominent Non-essential who took exception to the Allegorical Fundraiser Invite declined my request of splitting food costs.
On or about 12/30/2021 Your Servant, Covered on C Crew to raise awareness of the Blair COVID-19 Steering Committee, answered questions on how the meeting went with the Site Director and helped with the Fundraiser food prep. [Redacted] and [Redacted] did the bulk of the food prep and serving during the Fundraiser. I said my goodbyes with my Fellow Servants on C Crew and cleaned out my Control Room drawers and my locker. On my way up to 9th Hour Offering, I invited [Redacted] to “The 5th Floor Threshing Place” and told [Redacted] the Text of my Final Shift Exchange planned for the following morning. I told [Redacted] ALL my Concerns from a Big Picture Perspective (it wasn’t just about the DSP Building) and my Intentions to Blow the Whistle. I warned [Redacted] that they (some of the other Members of the Blair Site “Leadership” Team) would Pressure and possibly Persecute [Redacted] in the aftermath. I Strongly Recommended that [Redacted] “…tell the Truth, your Honest Opinions or NOTHING AT ALL!!!”
I traveled to the UPS Store in Bellevue to Print Off 50 Packets of my Preliminary Report that I was going to hand out to the Essential Workers on all Four Crews. I also swung by my House and gave my wife Red a Heads Up about my Final Shift Exchange Text, and I gave her a Packet with a synopsis of my Concerns from a Big Picture Perspective.
I returned to Work after Shift Exchange and to my Surprise my Scan Card worked at the Gate and the Door. I spoke to the Certain Tech and the Concerned Chemist and briefed them both on the OSHA’s Whistleblower Protection Program. I took the Certain Tech to “The 5th Floor Threshing Place” and told him ALL my Concerns from a Big Picture Perspective, my Text for my Final Shift Exchange and Phase Two of the Operation once the Blair Site “Leadership” Team removed me from the scene to push the Initiative. I also told the Certain Tech the names of my Fellow Servants who were helping on Phase Two and what their Specific Tasks were. I believe the Certain Tech later “Blew the Whistle” on all my Fellow Servants. When we returned to the Control Room, I was reminded by another Tech that tomorrow was a Holiday for the Day Shifters and it was unlikely that the Downstream Plant Manager would be present for Shift Exchange. I immediately “Adjusted Fire” and decided to write the Norbert Email with my Concerns of the Air Quality Issues in the DSP Building. The Certain Tech and the Concerned Chemist gave me their Versions of their Rudimentary Air Quality Tests and provided Format and Frequency Edits. I purposely did NOT mention any of my Concerns from a Big Picture Perspective. Only my Air Quality Concerns in the DSP Building and the Site Director’s False Report. After a final Proofread by the Concerned Chemist and the Certain Tech, we Simultaneously hit ENTER. I immediately took a picture of the Nobert Email proving I sent it. I mindfully decided NOT to BCC anyone. I told both that the entire Weight of Evonik AKA Degussa will come down on them. I Strongly Recommended that they Consider getting Employment Law Attorneys. I reminded the Certain Tech of his Phase Two Assignment and if he couldn’t handle it, then take UPTO for the remainder of his Scheduled Shift as I guessed Local Management would be Pressuring and Persecuting within the Hour. I needed to get Off Site and Publicly announce my Intention to go to OSHA before Local Management suspended me privately. I figured I had less than Eight Hours. I said my goodbyes and had to go through the Plant to get to my locker as my Scan Card had already stopped working. I had a few Photographs to Frame of my Locker before I could share my Final Shift Exchange Text.
